I first met Min Zhu in 2004 during his deposition in my lawsuit against the Zhus and WebEx. My previous interactions with him were limited to passing his phone messages to Erin between 1991 and 1999, receiving anonymous death threats made in his name in 2001 and 2002, and calling him with notice of my restraining order application against future threats of that nature. Based on these interactions, my impression of Min Zhu is that he is an engineer who has a hard time telling a lie, and a harder time restraining his anger. As a result, he relies on salesmen and lawyers when called upon to tell the truth or to face the consequences of his anger. I think that WebEx owes its success in equal measure to his performance as its head of engineering, and to its necessary mediation and mitigation by salesmen and lawyers. I think that WebEx is having a hard time maintaining its standing now that Min Zhu can no longer be publicly associated with it. ( Read more... )

Since December 29, 2001, Michael Zeleny has publicized child rape allegations repeatedly made since 1988 by Erin Zhu against her father Min Zhu, better known as the founder and former President and CTO of WebEx Communications, Inc. (NASDAQ:WEBX). On Friday, December 23, 2005, WebEx agreed to drop its libel lawsuit filed against Michael Zeleny for asserting that it squandered its shareholders’ assets on a failed coverup of child rape. This capitulation took place in response to Zeleny’s defense of truth asserted in the wake of two judicial sanctions imposed on WebEx for bad faith pleadings. WebEx’s aborted action against Zeleny has been funded by its shareholders’ assets.

LAUSD payoff to injured student only encourages more abusive attacks

The treatment David Grant received from the Los Angeles Unified School District after he was partially disabled in a campus accident a decade ago is shameful.
The former vocational student lost a leg — and maybe his youth — and was compensated as little as the district could legally get away with, his current medical bills. That turned out to be not much, thanks to an obscure and nonsensical law that classifies vocational students as employees, thus limiting their ability to sue.
After years of struggling with an unresponsive bureaucracy, workers’ comp and insurance companies, it’s not surprising the frustration drove Grant to extreme measures. What was surprising was the novel — and rather personal — way he did it.
Grant bought domain names for those who he felt were obstructing justice in his quest. One of them, royromer.com, bashed the LAUSD superintendent personally. The site included diatribes against Romer, quotes and, incongruously, pornography. Clearly, Grant had gone over the edge and had nowhere to turn.
Shockingly, his campaign worked. After more than a decade of rejecting his every claim, the school board agreed last week behind closed doors and without public discussion or adequate notice to pay Grant $360,000.
That payment is not for his pain and suffering but solely for medical bills for the rest of his life — or so LAUSD officials would have us believe.
The settlement is contingent on Grant leaving Romer and everyone else he’s harassed alone. He also has to surrender ownership of royromer.com to the LAUSD, which may be the real point to the deal.
If this was the right thing to do, it was the right thing to do a decade ago, before Grant went on the offensive. People harmed by the LAUSD shouldn’t have to go to extreme and absurd measures to get a fair deal.
Of course, if the payoff was for what could be construed as Internet blackmail, school officials have made a big mistake. By kowtowing to such tactics, they only will encourage imitators to use the Internet for abusive attacks on public officials.

It was April 28, 1995, and David Grant, an aircraft mechanics student at a Los Angeles Unified vocational education center in Van Nuys, was filling a split rim tire with air when suddenly his whole life changed.
The tire exploded and the 22-year-old suffered such serious injuries that his left leg had to be amputated above the knee and his right leg sustained severe and permanent damage.
That was the beginning of what spiraled into a 10-year saga with the nation’s second-largest school district fighting him all the way except for paying his current medical bills.
But Grant took his case public in a unique way. He used the Internet. He bought the domain name of LAUSD Superintendent Roy Romer — royromer.com — and domain names of the workers’ compensation attorney retained by the district, his own workers’ comp attorney, and even Los Angeles County Supervisor Zev Yaroslovsky [sic] to whom Grant had turned for help.
It was war, complete with pictures of the LAUSD superintendent under the title “Roy Romer’s House of Ill Repute,” diatribes about the case and even pornographic images.
Last Tuesday, Grant won the war — a $360,000 payoff contingent on his ending his Internet rampage. The Los Angeles school board agreed to the deal behind closed doors without any public discussion or clear public notice. ( Read more... )

A recent Wikipedia controversy concerns claims of Blixa Bargeld, the leader of pop music ensemble Einstürzende Neubauten, having married Erin Zhu for money that she earned under her father and ex-boyfriend Min Zhu, thoroughly degraded in the wake of his recent banishment as an executive and director of WebEx, an Internet conferencing company that he had co-founded. The attached emails shed light on these events.
At the time these emails were written, Erin Zhu described Michael Zeleny to all and sundry as her best friend, encouraged him to read her amorous correspondence, and sought out his advice in connection with wooing her illustrious beloved. Copies of these emails remain on file as public record. They can be found in the Santa Clara Superior Court case files of Zeleny v. Zhu & WebEx, Zelyony v. Zhu, and Affeld v. Zhu, all settled by the defendants in 2004. Erin Zhu has authenticated them under oath in her depositions taken in these cases.

Whilst peacefully picketing the WebEx User Conference in front of the Westin St. Francis hotel in the Union Square on May 2, Michael Zeleny and his faithful dog Cosmo both have been detained for questioning and psychological evaluation by the San Francisco Police Department and San Francisco animal control, respectively. As of this writing, the tests came out negative for Zeleny, determined fit to be released on his own recognizance. Cosmo remains in custody pending the determination of charges against him. Following a sanction awarded against them in Santa Clara for failing to stipulate to a change of venue, WebEx Communications, Inc. got judicially sanctioned for the second time yesterday for bringing up its mendacious libel lawsuit, Los Angeles Superior Court Case No. BC324927, against Michael Zeleny. Defendant Zeleny brought his anti-SLAPP motion against plaintiff WebEx on February 25, 20005, arguing that WebEx filed its lawsuit in order to infringe his Constitutional right to participate in a public forum. On March 16, 2005, Judge Michael L. Stern granted Zeleny’s motion on two out of three causes of action remaining against him. The fourth cause of action had been previously dropped by WebEx prior to their failed opposition in the November 5, 2004 hearing on Zeleny’s change of venue motion in Santa Clara Superior Court, where it originally filed its lawsuit. Upon the granting of that motion, Santa Clara Superior Court Judge Socrates Manoukian exercised his discretion in consideration of plaintiff WebEx having knowingly and maliciously brought up its lawsuit against defendant Zeleny in a wrong venue, by ordering them to pay his attorneys’ fees. Under California law, a similar award is mandatory in favor of defendant prevailing in an anti-SLAPP motion, in an amount to be determined in a subsequent hearing.
Thus WebEx shareholders continue paying for a failed attempt to cover up WebEx founder and ex-President Min Zhu’s rape of his daughter Erin Zhu. There remains their libel claim against Zeleny. WebEx objects to Zeleny’s claim that WebEx used 5,000 shares of its stock that it owed to Zeleny’s company to pay hush money to Min Zhu’s daughter Erin for her childhood rape by Min Zhu. WebEx further objects to Zeleny’s claim that his life had been threatened in the names and on the behalves of Min Zhu and WebEx. Look forward to hearings in this lawsuit determining the disposition of sociopathic child rapist Min Zhu on his way out as an executive of a publicly traded American corporation.

Min Zhu assured [Erin] that there was nothing wrong with [Erin] touching him in that way and that Min Zhu’s state of erection was normal. Min Zhu proceeded to turn on the lights, stating that he wanted to see [Erin] naked because he had never seen a virgin naked, since her mother was not a virgin when they were married. [Min Zhu] proceeded to place his hand between [Erin]’s legs and pronounced that the moisture in her vagina meant that her body was "being bad" and that she deserved to be punished. [Erin] attempted physically to refuse Min Zhu’s sexual advances. However, she was powerless to fight her father off. Min Zhu was approximately 39 years old, was a grown man in his prime, and was much larger and very much stronger than [Erin]. Min Zhu was approximately 5’11" tall and weighed approximately 160-170 pounds at that time. [Erin] was a fourteen-year-old girl, was only 5’4" tall and weighed less 90 lbs. Min Zhu became more aggressive and mounted [Erin]. When [Erin] struggled, Min Zhu began choking and restraining [Erin] with a blanket. He threatened to kill her. [Erin] stopped fighting her father as she was physically overpowered and feared that she would be severely harmed physically. [Erin]’s fear was all the more pronounced in light of Min Zhu’s long history of domestic violence and lack of remorse or conscience. Min Zhu then proceeded to rape [Erin].

On March 8 of 1991 Michael responded to an anonymous advertisement published on the Usenet newsgroup alt.personals as Message-ID 20113@samsung.samsung.com. As he found out later, it had been posted by Erin Zhu. The anonymous author described herself as an 18 year old female who “prefers unconventional just about everything, including clothes and people.” At that time, Michael attended Harvard College. At the same time, Erin Zhu attended Santa Clara University and lived at home with her parents Min Zhu and Susan Xu.
Over the next three months Erin gradually confided her family troubles to Michael in frequent email exchanges and phone conversations. According to her she was two years younger than stated in her ad, only about to turn seventeen on March 31 of 1991. Erin also informed Michael that she had lived in the United States over five years, arriving from China with her mother Susan Xu in 1985 to join her father Min Zhu, then a graduate student at Stanford since 1983.
Erin further informed Michael that three years after her arrival in the United States, in July of 1988, her mother went back to China for eye treatment. According to Erin, while her mother was away, her father Min Zhu came to her bedroom and raped her. Erin added that at the time of her sexual assault by Min Zhu, her brother Lei Zhu, two years her senior, remained in his bedroom next door and heard her struggle and cry out, but did nothing. At the time of this sexual assault, Erin was fourteen years old.
